Terms & Conditions

1. Membership and Entry

By obtaining a membership or entering our studio, you agree to abide by our Terms and Conditions. 

When you obtain a membership or physically enter our studio, it means you accept and are bound by our Terms and Conditions. We may update our Terms and Conditions from time to time. We'll notify you in writing through email, our website, or by sharing the changes at the studio. We encourage you to familiarise yourself with the Terms and Conditions and check for updates regularly. We want to create a positive environment for everyone. However, we reserve the right to refuse entry to or eject individuals from our studio for any reason.

 

Participants joining mat classes must be at least 14 years old, while for reformer classes, the minimum age is 16. For individuals under 18, written parental consent is required for class participation, obtainable by contacting the studio or using the form on the website.

2. Safety and Health

Participating in any activities (exercise, meditation or mindfulness practices) at our studio is done at your own risk. If you have any doubts about your ability to engage in these activities, we recommend seeking medical advice beforehand. It's important to inform us and our instructors about any health risks or medical conditions you have before participating in our classes or workshops. If you have a medical condition, we strongly recommend seeking approval from a medical practitioner. Engaging in exercise with a medical condition is solely at your own risk. Our instructors may provide physical correction during classes to ensure proper practice methods. Participating in these methods is entirely at your own risk.

We're unable to take responsibility for the safekeeping of your personal belongings. We recommend bringing only necessary items into the studio during your visit. Respect for others' personal belongings is important. Interfering with, tampering, stealing, or causing damage or loss to another person's belongings at the studio is strictly prohibited. Such actions may result in the cancellation of your membership and a permanent ban from our studio.

 

3. Schedule, Teacher and Event Changes

Sama House reserves the right to cancel, modify and change teachers, class schedules, class styles, events, and workshops without prior notice.

4. Privacy and Third-Party Services​

We value your privacy and comply with the Privacy Act. Our privacy policy is available on our website. If you have any privacy concerns or requests regarding your personal information, please contact us at hello@samahouse.com.au.

We utilise a third-party client management software called "Momence". Your personal information will be shared with Momence to create a membership or book classes. Momence's use of personal information is governed by its privacy policy.

 

5. Booking and Attendance

To attend a class, please pre-book your spot using our online booking system. The booking cut-off is set at 20 minutes prior to the start of the class. To enhance your experience and secure a spot in the class, we discourage walk-ins, as space cannot be guaranteed. If you have booked a class and need to cancel your attendance, please do so through our online booking system at least 6 hours before the scheduled class time to avoid penalties. Late cancellations (within 6 hours of class) will incur a fee of $10 and no-shows will incur a fee of $15 and a lost class pass. However, we understand that sometimes life throws curveballs! To offer some flexibility, we have a 'when-life-happens' freebie. Each client is allowed one free late cancellation or no-show within any 4-week period. This means that if you late cancel or no-show once, you won’t be charged. However, if you late cancel or no-show again within the following 4 weeks, you will be charged the fee. After those 4 weeks, your free late cancellation or no-show resets.

 

6. Membership Terms and Conditions

Membership is available to individuals aged 18 years and over. Membership sales are final. We do not offer refunds for change of mind, user error, injury, illness, change of address, unsuitability, or any other reason, except as required by law. Memberships are for personal use only and are non-transferable. Selling, trading, gifting, sharing, providing, or transferring memberships to others is strictly prohibited. Violation of this policy may result in the permanent cancellation of your membership and a ban from our studio. We offer gift cards for sale, which can be redeemed for membership creation. Gift cards are not redeemable for cash.

If you need to suspend your membership, please send an e-mail to hello@samahouse.com.au at least 7 working days ahead of your next billing date. The minimum suspension period is one week and the maximum is five weeks per year. Please note that some of our memberships require a minimum contract period, as specified on the membership purchase page. After the minimum contract period, debits will continue as usual unless you request to cancel your membership via email.

Our auto-debit memberships have a minimum contract of 3 months. If you wish to cancel your membership before the minimum contract period, a $100 cancellation fee is applicable, or the remaining balance, whichever is less.

 

All membership cancellations require at least 2 weeks' notice (via email).

 

7. Fees and Pricing

We reserve the right to adjust fees for ongoing memberships after the minimum commitment period, with 8 weeks' notice. We'll inform you in writing of any changes. If you don't agree with the changes, you may cancel your membership according to the Terms and Conditions. We may change fees for new memberships at any time.

 

8. Liability and Indemnity

Our services come with consumer guarantees as per the Australian Consumer Law (ACL). Besides the consumer guarantees and other applicable laws, we exclude any implied terms, conditions, or warranties. To the extent permitted by law, we, our representatives, and instructors are not liable for any injury, illness, damage, or loss sustained directly or indirectly while participating in our classes or visiting the studio. By accepting our Terms and Conditions, you release us from any related claims.

 

9. Intellectual Property

Our logos, materials, and intellectual property are protected. You are not permitted to copy, reproduce, sell, distribute, license, or use our intellectual property without prior written consent.
